Not every repeat DWI charge is a felony. North Carolina draws an important line based on how many prior convictions you have and how far back they go:
- A prior DWI within the past 7 years counts as a grossly aggravating factor under North Carolina's sentencing structure, which significantly increases the mandatory penalties for your current misdemeanor charge — even if this is only your second offense.
- Three or more DWI convictions within the past 10 years elevate the charge itself to felony "habitual impaired driving," a Class F felony carrying a mandatory active prison sentence.
In other words, a second DWI is usually still a misdemeanor — but a serious one, with mandatory jail exposure that a first offense typically doesn't carry. A third DWI, depending on timing, may push a case into felony territory.
