Raleigh Domestic Violence Defense Attorney
Direct Representation When Criminal Charges and 50B Proceedings Overlap
A domestic violence allegation can create immediate legal problems involving a criminal case, a Domestic Violence Protective Order, or both.
At Cotten Law Firm, PLLC, you work directly with Attorney Jeremy Cotten. Our boutique approach gives you a consistent point of contact while we review the allegations, court documents, available evidence, and deadlines that may affect your response.
If you have already been served with a protective order, follow its terms carefully while preparing your defense. Do not assume that contact initiated by the other person changes the restrictions imposed on you.
Call (984) 253-4337 or contact us online to speak with us about your charges, protective order, or upcoming hearing and schedule a consultation.
Criminal Domestic Violence Charges in North Carolina
North Carolina domestic violence cases can involve several criminal statutes.
Current law includes N.C.G.S. §14-32.5, which creates a Class A1 misdemeanor crime of domestic violence when the statutory conduct and relationship requirements are met.
Other incidents may involve separate allegations such as assault, threats, stalking, strangulation, or violation of a protective order depending on the facts.
North Carolina also has an habitual domestic violence statute that can create felony exposure when its statutory requirements and qualifying prior convictions are satisfied.
The charge name alone does not establish what the State can prove. We examine the exact statute, alleged relationship, witness accounts, physical evidence, communications, and procedural history before evaluating the available defense options.
A 50B Protective Order Is a Separate Civil Proceeding
A Domestic Violence Protective Order, often called a DVPO or 50B order, is a civil court order rather than a criminal conviction.
A person seeking a 50B order can request emergency or ex parte relief before the defendant has an opportunity to respond. If a temporary order is entered and served, North Carolina law provides for a prompt subsequent hearing where the parties can present evidence.
A 50B order can impose significant restrictions involving contact, residence, locations the defendant may enter, and other conduct specified by the court. In qualifying circumstances, firearm surrender requirements may also apply.
Although the protective-order proceeding is civil, it can arise from the same alleged events as a criminal case. Decisions involving testimony, evidence, and communications in one proceeding can therefore affect the strategy used in the other.
Violating a 50B Order Can Create a New Criminal Case
A valid protective order should be followed exactly while it remains in effect.
Under N.C.G.S. §50B-4.1, knowingly violating a valid protective order generally constitutes a Class A1 misdemeanor, with different or more serious consequences possible in circumstances addressed by the statute.
The fact that the plaintiff initiates contact does not automatically authorize the defendant to disregard restrictions that still apply under the court order.
If you are uncertain about what an order permits, obtain legal guidance rather than relying on informal agreements or assumptions.
How We Review Domestic Violence Allegations
Domestic violence cases can turn on conflicting accounts of a private event.
We begin by listening to your description of what happened and comparing it with the evidence available to the State or the opposing party.
Depending on the matter, relevant evidence can include:
- Witness statements
- Text messages and other communications
- Photographs or video
- Body-camera or 911 evidence
- Medical records
- Prior communications between the parties
- Protective-order filings
- Police reports
- Other records relating to the alleged incident
Our review may address whether the evidence supports each required legal element, whether witness accounts are consistent, whether self-defense or another factual issue is relevant, and whether evidence was obtained or presented properly.
No single defense applies to every domestic violence allegation.
When Criminal and Civil Cases Move Forward at the Same Time
A criminal domestic violence prosecution and a 50B proceeding are legally separate even when they arise from the same alleged incident.
The criminal case requires the State to prove the charged offense beyond a reasonable doubt.
A 50B proceeding follows the civil process under Chapter 50B and determines whether protective relief should be entered or continued.
Because testimony and evidence may overlap, a decision made in one proceeding can have practical consequences for the other. We evaluate the complete situation rather than treating each court date in isolation.

What to Do After Being Charged or Served With a 50B Order
Read every criminal-court and civil-court document carefully.
Make note of:
- Upcoming court dates
- Contact restrictions
- Residence or location restrictions
- Firearm-related terms
- Conditions of release
- Documents or evidence you may need to preserve
Do not alter or delete potentially relevant messages, photographs, or other records.
If law enforcement wants to question you about the allegations, consider obtaining legal advice before discussing the facts of the case.
